1. General

  1. These Terms govern use of the website at www.artosfoundation.ai (the “Service”) and the electronic supply of services, including creating and running a member account.
  2. The Terms are made available free of charge in a form that can be saved and printed, under art. 8 of the Polish Act of 18 July 2002 on providing services by electronic means (“UŚUDE”).
  3. This English version is a courtesy translation. In case of any discrepancy between language versions, the Polish text (Regulamin) prevails.

2. Provider

The provider is Fundacja na rzecz Integracji i Rozwoju Nowoczesnych Technologii oraz Sztucznej Inteligencji w Branży Filmowej ARTOS (in English: Foundation for Integration and Development of New Technologies and Artificial Intelligence for the Film Industry ARTOS; operating name “ARTOS Foundation”), a foundation under Polish law, seated in Warsaw:

3. Definitions

“Provider/Foundation” — the entity in section 2. “User” — a natural person using the Service; for a member account, a person aged at least 16. “Member” — a User who has created an account. “Account” — the Member’s individual password-protected panel. “Services” — the electronic services in section 5. “Privacy Policy” — the document describing personal-data processing, integral to these Terms.

4. Technical requirements

A device with Internet access, a current browser with JavaScript and session cookies enabled, and an active email account. The Provider aims for correct operation but does not guarantee uninterrupted availability.

5. Scope of Services

  1. The Provider supplies electronically: (a) public site content without login; (b) creating and running a member Account; (c) after login, the member area including the news channel (Overview, Latest News), publications library, Screening Room, the community forum, and the public members list (“community” page); (d) contact form and email; (e) donations to the Foundation’s statutory purposes via an external payment operator; (f) a newsletter, subject to separate consent.
  2. Membership is currently free of charge. The Foundation may introduce paid membership plans in the future; paid terms will be presented as a separate offer and accepted before any paid contract is concluded, with consumer rights preserved (section 9).

6. Conclusion and termination of the Account contract

  1. The Account contract is concluded, for an indefinite term, upon confirming registration (clicking the activation link sent by email).
  2. Registration requires: name (or organization name), email, and a password; optionally an organization name. Publishing a name on the public members list and the organization name occurs only on the basis of voluntary, separate consents (form checkboxes).
  3. Registration requires reading and accepting the Terms and Privacy Policy and a declaration of being at least 16 years old.
  4. The User may terminate the Account contract at any time without cause by deleting the Account or emailing contact@artosfoundation.ai. Deletion is carried out promptly, save data that must be retained by law.
  5. The Provider may terminate on 14 days’ notice, or block/delete the Account with immediate effect for a material breach, after prior notice where possible.

7. Use and user content

  1. Supplying unlawful content is prohibited (art. 8(3)(2)(b) UŚUDE).
  2. The User must use the Service lawfully and in line with the Terms, must not disrupt it, and must keep the password confidential.
  3. Forum content remains the User’s; the User grants the Foundation a non-exclusive, royalty-free licence to display it in the Service as needed to provide the Service. The Provider may remove unlawful content upon credible notice.

8. Payments (donations and future paid plans)

  1. Donations are voluntary and handled by an external payment operator — PayU S.A. — under that operator’s terms. The Foundation does not store full card data; payment data is processed by the operator as a separate controller/processor.
  2. If paid membership plans are introduced, distance-contract rules apply (section 9).

9. Consumer rights (future paid services)

  1. The Act of 30 May 2014 on consumer rights applies to Users who are consumers or entrepreneurs with consumer rights.
  2. A consumer concluding a paid distance contract may withdraw within 14 days without cause. If a digital service starts before that period ends, it does so at the consumer’s express request and with acknowledgement that the right of withdrawal is lost upon full performance (or with a duty to pay for what was performed up to withdrawal).
  3. Donations, being gratuitous, are not sales contracts and are not subject to the withdrawal right applicable to paid contracts.

10. Complaints

Complaints may be sent to contact@artosfoundation.ai and should identify the User and describe the issue. The Provider replies within 14 days by email. Consumers may use out-of-court redress, including the EU ODR platform (ec.europa.eu/consumers/odr).

11. Liability

The Provider supplies Services with due care and is not liable for interruptions beyond its control or force majeure, nor for use contrary to the Terms. This does not limit liability toward consumers where mandatory law forbids such limitation.

12. Personal data

Processing is described in the Privacy Policy. The Foundation is the data controller.

13. Changes

The Provider may amend the Terms for valid reasons (law changes, scope, security), notifying Members by email and in-Service at least 14 days ahead. Continued use means acceptance; objection ends the Account contract.

14. Final provisions

Polish law governs, without depriving consumers of mandatory protections of their habitual residence. Matters not covered are governed by Polish law, in particular the Civil Code, UŚUDE, the Consumer Rights Act, and the GDPR. The Polish version prevails in case of discrepancy.

The Foundation has not appointed a Data Protection Officer; data-protection matters are handled directly by the controller at the email above. This English version is a courtesy translation — in case of discrepancy, the Polish version (Polityka prywatności) prevails.

2. Purposes, data, and legal bases

3. Whether data is required

Name, email, and password are voluntary but necessary to create an account; without them the account contract cannot be concluded. Consents for the public members list, the organization name, and the newsletter are entirely optional and do not condition account creation.

4. Recipients and processors

The controller uses trusted providers under art. 28 GDPR data-processing agreements:

  • Supabase — database hosting and authentication (account data; passwords stored hashed), and delivery of account-related transactional emails (registration confirmation, password reset).
  • Vercel — app hosting, server rendering, logs (serverless functions run in region iad1 — Washington, USA).
  • PayU S.A. — payment operator for donations; a licensed Polish payment institution seated in Poznań, handles payment data under its own privacy policy.
  • Newsletter delivery provider — only if and when a newsletter is launched; until then no data is shared with any provider for this purpose.

Data may be disclosed to public authorities where required by law.

5. Transfers outside the EEA

  1. Some providers (Supabase, Vercel) may process data on servers in the United States, which is a transfer outside the EEA.
  2. Transfers rely on: (a) the European Commission adequacy decision under the EU–US Data Privacy Framework, where the provider holds an active DPF certification; and (b) Standard Contractual Clauses (SCCs) as a supplementary safeguard and fallback should the DPF status change.
  3. You may request a copy of the safeguards used at contact@artosfoundation.ai.

6. Retention

Account data is kept for the life of the account contract and deleted promptly on account deletion, except data required by law. Donation accounting data is kept for the period required by accounting and tax law (as a rule 5 years from the end of the relevant year). Consent-based data (members list, newsletter) is kept until consent is withdrawn. Legitimate-interest data is kept until an effective objection or the purpose ends; claims data until limitation periods expire.

7. Your rights

You have the rights of access, rectification, erasure, restriction, data portability, objection to processing based on legitimate interest, and withdrawal of consent at any time (without affecting the lawfulness of prior processing). Exercise via contact@artosfoundation.ai. You may lodge a complaint with the supervisory authority, the President of the Personal Data Protection Office (PUODO), ul. Stawki 2, 00-193 Warszawa, uodo.gov.pl.

8. Automated decisions

No decisions producing legal effects are made solely by automated processing, including profiling.

9. Cookies

The Service uses cookies strictly necessary to keep the logged-in session (authentication); these require no consent. The Service currently uses no analytics or marketing cookies. Should any be introduced, they will run only after consent via a cookie banner, withdrawable at any time.

10. Changes

The controller may update this Policy and will notify Members of material changes by email or in-Service. The date and version appear at the top. The Polish version prevails in case of discrepancy.
